What is Compliance?
Compliance Programs are crucial to protect legal entities from criminal liability. Since their inception in Spain in 2010, these programs ensure that organizations comply with current legislation. Criminal Compliance involves a comprehensive crime prevention plan, incorporating tools to avoid infractions and irregularities. It is based on two concepts: compliance itself, aimed at preventing crimes, and Criminal Law, which regulates the punitive power of the State. The implementation of Criminal Compliance seeks to prevent crimes according to the scope and size of the company, allowing greater visibility and control. It is not mandatory, but its adoption can exempt or mitigate criminal liability, according to article 31 bis of the Penal Code in Spain.
